Legally, do I have to use an estate agent to sell my property?
No! There is no law to say that you have to sell or let your property through an estate agent. In fact, by selling or letting privately, you will potentially be saving thousands of pounds as you will not have to pay any commission. Can I to sell a house privately, if I already have an estate agent?
Yes, you can sell or let your house or property privately even if your contract says 'sole agency'. Sole agency simply means that you are not able to use another estate agent. As you are not an estate agent, you are able to sell a house, flat, bungalow or home privately. Effectively, you are advertising your property on Sellmycave and buyers contact you directly. If you sell your own property, you will not have to pay your estate agent any commission. Sellmycave is a private home sales (for sale by owner, FSBO) website- we are NOT estate agents.
My contract says 'sole selling rights', what does this mean?
'Sole selling rights' is a dated term that very few estate agents still use. If your contract specifies that they have sole selling rights, it will mean that even if you sell your own property, they may claim their commission. Most sole selling contracts have a time frame, so Sellmycave suggests that you wait until this is up before selling privately. Does my estate agent need to know if I am selling privately?
We recommend that you do tell your estate agent, as this will disperse any confusion. In our experience, most estate agents do not mind if you choose to sell a house, home or flat privately alongside their sale and often it will make your estate agent work extra hard to find you a buyer. We also recommend that if your buyer has been introduced to you through the estate agent, at any stage in the process, that you honour your agreement to pay the commission.
